These Terms of Service (“Terms”) govern your access to and use of avastarhealth.com and our OptimaLife™ online store (together, the “Site”) and any related forms, content, or digital communications operated by Avastar Health (“Avastar,” “we,” “our,” or “us”). By accessing or using the Site, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. No Doctor-Patient Relationship

Use of this Site, purchase of any product, submission of a form, or other electronic communication with Avastar Health does not create a doctor-patient relationship. A formal doctor-patient relationship is established only upon completion of an in-person or formal telehealth consultation with an Avastar Health clinician, following intake and mutual agreement to treatment.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use this Site, place an order, or submit any form. If you are submitting information on behalf of a minor, you represent that you are the parent or legal guardian and authorized to do so.

4. Permitted Use

Our Site uses third-party tools, including but not limited to Shopify (our e-commerce and checkout platform), UpPromote (our affiliate program platform), and CRM/form providers for submissions and scheduling. Our total aggregate liability for any claim arising out of or relating to these Terms or the Site shall not exceed one hundred U.S. dollars (US $100).

You agree to defend, indemnify, and hold harmless Avastar Health and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We may revise these Terms at any time by updating this page. The “Last Updated” date reflects the most recent revision. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
